Neal Gozzett has been successful in opposing an application under section 22 of the Proceeds of Crime Act 2002 after submitting lengthy written submissions to the Crown Prosecution Service.

This section of the Act allows the Prosecution to ask the court to reconsider the “available amount” of a confiscation order where there are additional assets available and it is just to do so.

Neal persuaded the CPS not to apply to the court for the full amount, thus avoiding his client having to pay a large sum of monies to the relevant authority.
